Vacavision Co. Privacy Policy

Vacavision Co. ("the Company," "we," "us") is committed to protecting the privacy of our customers and the data generated through use of our livestock monitoring platform.
This Privacy Policy describes what data we collect, why we collect it, how we use it, and the rights you have over it. Our practices are designed to comply with applicable privacy laws governing our operations in the United States and internationally.
1. Notice
We will ask you when we need information that personally identifies you (personal information) or allows us to contact you. Generally, this information is requested when you create a Registration ID on our dashboard, download our software, or subscribe to our monitoring services.
Livestock Monitoring and Video Data: By utilizing Vacavision’s computer-vision system, you acknowledge and agree that:
- Hardware and Cameras: Our system utilizes cameras and specialized hardware installed on-site to monitor livestock behavior, health, and productivity.
- Server Transmission: All raw video streams, images, and sensor data captured by our hardware are automatically transmitted to and stored on our secure cloud servers for processing and analysis by our proprietary AI models.
- Incidental Capture: While our system is designed to monitor cattle, video footage may incidentally capture images of individuals present within the camera’s field of view. We do not use incidentally captured footage to identify individuals or for any purpose other than providing and improving the Services, and we do not sell it. The operator of the monitored premises (the employer) is responsible for notifying its personnel of on-site video monitoring and obtaining any consents required by applicable workplace-surveillance law, as set forth in our commercial agreements.
We use your Information for four primary purposes:
- 1. To make the platform easier for you to use by not having to enter information more than once.
- 2. To provide you with real-time behavioral insights, fertility alerts, and health analytics.
- 3. To help us create and deliver content and software improvements most relevant to your farming operations.
- 4. To train and improve our machine-learning algorithms and computer-vision models.
2. Consent
If you choose not to register or provide personal information, you can still use some parts of our website, but you will not be able to access areas that require registration or utilize the Vacavision monitoring services.
If you decide to register, you will be able to select the kinds of information you want to receive from us by subscribing to various services, like our electronic newsletters. If you do not want us to communicate with you about other offers regarding Vacavision products, programs, or services by email, postal mail, or telephone, you may select the option stating that you do not wish to receive marketing messages.
3. Access
We will provide you with the means to ensure that your personal information is correct and current. You may review and update this information at any time at the Vacavision Dashboard. There, you can:
- View and edit personal information you have already given us.
- Tell us whether you want us to send you marketing information.
- Subscribe or cancel subscriptions to alerts and newsletters.
4. Security
Vacavision Co. has taken strong measures to protect the security of your personal information and your operational data. We ensure that your data is protected from loss, misuse, unauthorized access or disclosure, alteration, or destruction.
We use commercially reasonable technical and organizational measures to protect your data against unauthorized access, loss, or disclosure. When you access your account or view video analytics, data is transmitted over encrypted connections (TLS/SSL). No method of transmission over the Internet is completely secure, and we cannot guarantee absolute security; however, we continuously work to improve our security practices.
Inside the Company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in the United States or any other country where Vacavision Co., its subsidiaries, affiliates, or agents are located.
5. Enforcement
If for some reason you believe Vacavision Co. has not adhered to these principles, please notify us by email, and we will do our best to determine and correct the problem promptly. Be certain the words "Privacy Policy" are in the Subject line.
6. Data storage and server processing
You specifically consent to the Company’s practice of uploading all video data and metadata to our central servers. This centralized processing is a technical requirement for the Vacavision AI to function. We implement commercially reasonable security measures to ensure that your farm’s visual data remains confidential and is used solely for the purposes of providing and improving our services.
7. Disclosure of information
Vacavision Co. will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to:
- 1. Conform to the edicts of the law or comply with legal process served on Vacavision Co. or the site;
- 2. Protect and defend the rights or property of Vacavision Co. and its family of Websites and AI assets; and,
- 3. Act in urgent circumstances to protect the personal safety of users of Vacavision Co., its Websites, or the public.
8. Your data rights: access, rectification, and deletion
You have the right to manage the data we collect about you and your operations. In accordance with applicable laws, including the Delaware Personal Data Privacy Act and other privacy laws applicable in the jurisdictions where our clients operate (including, as applicable, the laws of California, Texas, Tennessee, Michigan, and Alabama, and Colombia’s Law 1581 of 2012), you may exercise the following rights:
- Right to Access: You may request a copy of the personal data we hold about you and information regarding how we process the video data from your farm.
- Right to Rectification: You may request that we correct any inaccurate or incomplete personal information.
- Right to Deletion ("Right to be Forgotten"): You may request that we delete your personal data from our systems.
- Please note: If you request the deletion of data that is essential for the Vacavision AI to function (such as historical video logs required for health pattern recognition), our ability to provide the Services may be limited or terminated.
- Exceptions: We may retain certain data as required by law, for legitimate business purposes (such as billing), or to defend legal claims. A deletion request removes identifiable personal data from our active systems; it does not extend to aggregated or de-identified data, or to insights already incorporated into trained AI models, which may be retained under our commercial agreements.
- Right to Opt-Out: You may opt-out of the processing of your data for profiling or targeted advertising at any time.
How to contact us: To exercise any of these rights, please contact our Data Privacy Team at privacy@vacavision.co. We will respond to your request within forty-five (45) days, as required by law.
9. Data retention
We retain raw video footage and sensor data for as long as reasonably necessary to provide the Services, train and improve our AI models, and comply with our contractual and legal obligations. Personal account information is retained for the duration of the customer relationship and any period thereafter required by law. Aggregated and de-identified data may be retained indefinitely.
10. Sub-processors and cloud infrastructure
We use third-party service providers to host and process data on our behalf. Our primary cloud infrastructure provider is Google Cloud, whose data centers are located in the United States. A current list of our sub-processors is available upon request at privacy@vacavision.co. All sub-processors are bound by contractual obligations of confidentiality and data protection consistent with this Privacy Policy.
11. Security breach notification
If we become aware of a security breach affecting your personal data, we will notify affected customers without undue delay and within the timeframes required by applicable law, and will provide information reasonably available to us about the nature of the breach, the data affected, and the measures taken in response.
12. Cookies and website analytics
Our website, vacavision.co, and the Vacavision Dashboard use cookies and similar technologies to keep you signed in, remember your preferences, and understand how our services are used. You can manage or disable cookies through your browser settings; some features may not function properly without them.
13. Children’s privacy
Our services are intended for business use and are not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact privacy@vacavision.co and we will delete it.
14. International data transfers
Vacavision operates in the United States and Colombia. Where personal data collected in Colombia is transferred to and processed in the United States, we do so with the data subject’s authorization and under safeguards consistent with Colombia’s Law 1581 of 2012 and its implementing decrees. By using our services, you consent to the transfer, storage, and processing of your data in the United States.
15. Governing law
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree that any legal action or proceeding between Vacavision Co. and you for any purpose concerning this Privacy Policy shall be brought exclusively in a court of competent jurisdiction sitting in Delaware.
